These Terms of Use (“Terms”) govern your use of roughtradesolutions.net (the “Site”), operated by Rough Trade Solutions LLC, which owns and operates N-Hance of The Woodlands (“Rough Trade Solutions,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Use of the Site

You may use the Site for lawful, personal and non-commercial purposes, such as learning about our services and requesting an estimate. You agree not to misuse the Site, including by submitting false information, interfering with its operation or security, attempting to gain unauthorized access, or using automated means to collect content from it without our permission.

Information on the Site; estimates and pricing

We try to keep the information on the Site accurate and current, but it is provided for general informational purposes only. Prices, timelines, examples, photos and descriptions of services are illustrative and may change without notice. Results vary depending on the condition, material and size of your cabinets and other surfaces. A request submitted through the Site is not a contract. Your final price, scope of work and schedule are confirmed during your in-home estimate and in any written agreement between you and us.

Warranty

Any warranty for our work is provided only under the written warranty terms given to you with your project. Nothing on the Site creates any additional warranty.

Intellectual property

The Site and its content, including text, photos, graphics and logos, are owned by or licensed to Rough Trade Solutions LLC and are protected by copyright and other laws. You may not copy, reproduce, distribute or create derivative works from the Site’s content without our prior written permission. N-Hance®, Lightspeed® and related marks are trademarks of their respective owners and are used under license. Rough Trade Solutions LLC is an independent company that owns and operates the N-Hance of The Woodlands franchise.

Third-party links and services

The Site may contain links to third-party websites and services, such as nhance.com, Google and wisetack.com. We do not control and are not responsible for their content, policies or practices, and your use of them is at your own risk and subject to their terms.

Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or free of viruses or other harmful components.

Limitation of liability

To the fullest extent permitted by law, Rough Trade Solutions LLC and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising out of or related to your use of, or inability to use, the Site. This section applies to your use of the Site only and does not limit any rights you have under a written agreement for our services.

Indemnification

You agree to indemnify and hold harmless Rough Trade Solutions LLC and its owners, employees and agents from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Texas, and you consent to the jurisdiction of those courts.

Our Privacy Policy explains how we collect and use information through the Site and is part of these Terms.

Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the effective date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms are the entire agreement between you and us about the Site.
